Terms of Use.

Please read these Terms of Use carefully before using this website. These Terms of Use govern your access to and use of the Framework Travel LLC website located at www.framework-travel.com (the “Site” or the “Service”), including any content, features, and the ability to purchase select services directly through the Site’s cart. These Terms of Use are separate from, and in addition to, our Booking Terms & Conditions, which govern your engagement of Framework Travel as your travel advisor, and our Privacy Policy, which governs how we handle your personal information.
1. Interpretation and Definitions
The following definitions apply to these Terms of Use, regardless of whether they appear in the singular or plural:
“Company,” “we,” “us,” or “our” refers to Framework Travel LLC.
“Country” refers to New York, United States.
“Service” or “Site” refers to the Framework Travel LLC website, accessible at www.framework-travel.com, www.frameworktravel.com
“Terms of Use” or “Terms” means this agreement, which forms part of the entire agreement between you and the Company regarding use of the Site.
“You” means the individual accessing or using the Site, or the company or other legal entity on behalf of which such individual is accessing or using the Site, as applicable.
2. Acknowledgement
These Terms of Use govern your use of the Site and the agreement that operates between you and the Company. Your access to and use of the Site is conditioned on your acceptance of and compliance with these Terms.
By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Site.
You represent that you are over the age of 18. The Company does not permit those under 18 to use the Site.
Your access to and use of the Site is also conditioned on your acceptance of the Company’s Privacy Policy, which describes how we collect, use, and disclose your personal information. Please read our Privacy Policy before using the Site.
3. Purchases and Custom Bookings
Certain services may be purchased directly through the Site’s cart. All purchases made through the Site’s cart, as well as any custom travel services booked through an individually issued invoice, are governed by our Booking Terms & Conditions in addition to these Terms of Use. In the event of a conflict between these Terms of Use and the Booking Terms & Conditions as to the provision of travel advisory or booking services, the Booking Terms & Conditions control.
The Company reserves the right to refuse or cancel any order placed through the Site at its discretion, including in cases of suspected error, fraud, or unauthorized or illegal activity.
4. Links to Other Websites
The Site may contain links to third-party websites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party website you visit.
5. Termination
We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including if you breach these Terms of Use. Upon termination, your right to use the Site will cease immediately.
6. Limitation of Liability
Notwithstanding any damages that you might incur, the entire liability of the Company and its suppliers under any provision of these Terms, and your exclusive remedy for all of the foregoing, shall be limited to the amount actually paid by you through the Site, or $100 USD if you have not purchased anything through the Site. This limitation applies to use of the Site itself and does not limit the liability terms set out in our separate Booking Terms & Conditions governing travel advisory services.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including but not limited to damages for loss of profits, loss of data, business interruption, or personal injury) arising out of or related to the use of or inability to use the Site, even if the Company has been advised of the possibility of such damages.
Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you. In those states, each party’s liability will be limited to the greatest extent permitted by law.
7. “As Is” and “As Available” Disclaimer
The Site is provided to you “AS IS” and “AS AVAILABLE,” with all faults and defects, without warranty of any kind. To the maximum extent permitted by law, the Company expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. The Company makes no representation or warranty that the Site will meet your requirements, operate without interruption, be error-free, or that the Site, its servers, or emails sent from the Company are free of viruses or other harmful components.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on applicable statutory consumer rights, so some or all of the above exclusions may not apply to you. In such cases, the exclusions and limitations in this section apply to the greatest extent enforceable under applicable law.
8. Governing Law
The laws of the State of New York, United States, excluding its conflict-of-law rules, govern these Terms and your use of the Site.
9. Dispute Resolution
If you have any concern or dispute about the Site, you agree to first try to resolve the dispute informally by contacting the Company.
10. United States Legal Compliance
You represent and warrant that (i) you are not located in a country subject to a United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) you are not listed on any United States government list of prohibited or restricted parties.
11. Severability and Waiver
Severability. If any provision of these Terms is held to be unenforceable or invalid, that provision will be changed and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
Waiver. Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise that right or require that performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.
12. Changes to These Terms of Use
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Site after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, please stop using the Site.
